Terms of Use
Waypath is operated by Hugo Moriceau. Using the app or this website means accepting what follows. It is written to be read, not to be impenetrable.
The licence for the app itself
The Waypath app is licensed, not sold, under Apple's Standard End User Licence Agreement. These terms cover the service behind it: your account, the community, and live sharing.
Your account
You need an account for the social and sharing features. Recording activities for yourself does not require one. You must be at least 16. Keep your sign-in details to yourself, and tell us if you think someone else has them.
You can delete your account at any time from Settings. Deletion is real: your profile, activities, photos, messages and social connections are removed, and so are the files you uploaded.
Your content stays yours
Activities, photos, comments and routes you create remain your property. By publishing them you give us the permission we need to operate the service: to store them, and to display them to the people you chose to show them to. That permission ends when you delete the content or your account. We do not sell your content, and we do not use it to train anything.
How to behave
Do not post content that is unlawful, hateful, harassing, sexual, or that infringes someone else's rights. Do not upload a photograph of someone who has not agreed to it. Do not impersonate anybody. Do not scrape the service, hammer it with automated requests, or try to reach data that is not yours.
Report anything that breaks these rules using the report control in the app. We may remove content and suspend accounts, and we will act faster where someone's safety is involved.
Live sharing, and what it is not
Live sharing shows people holding your link roughly where you are while it is switched on. Read this part carefully, because it is where expectations go wrong:
- It is a spectator view, not a timing system. It does not produce official results, does not replace chip timing, and must not be relied on to time or rank a race.
- It is not a safety service. It depends on your phone having battery and a mobile signal, both of which fail in exactly the places people most want to be found. Do not use it as your only plan in the mountains, and do not let anyone else treat it as one.
- Positions are approximate, updates can be delayed, and the first part of your route is deliberately withheld so a link never reveals where you set off from.
- Anyone you give the link to can pass it on. Share it with people you trust.
Subscriptions
Waypath has a free tier and a paid subscription. Purchases are made through Apple and are governed by Apple's terms. A subscription renews automatically unless you cancel it at least 24 hours before the period ends, and you cancel it in your Apple ID settings rather than here. Prices vary by country and can change, with notice.
Refunds are handled by Apple, not by us, through reportaproblem.apple.com. If you are in the EU or UK, your statutory rights are unaffected by anything here.
Trail data and maps
Trail and map data comes from OpenStreetMap contributors under the Open Database Licence. It is contributed by volunteers and can be incomplete or out of date. A path shown in Waypath may be impassable, private, or gone. Use judgement, and check conditions before you go somewhere remote.
Availability
We try to keep the service running but do not promise it will be uninterrupted. Features can change, and occasionally one is removed. Where a change is significant, we will say so in the app.
Liability
Sport carries risk, and the decisions you make outdoors are yours: route choice, conditions, your own fitness, and whether to turn back. Waypath is a tool for recording and sharing, not advice, and not a substitute for preparation or for telling somebody where you are going.
To the extent the law allows, we are not liable for indirect or consequential loss. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights stand.
Ending it
You can stop using Waypath and delete your account whenever you like. We may suspend or close an account that seriously or repeatedly breaks these terms, and except where the law requires otherwise we will tell you why.
Changes to these terms
We will update this page and change the date at the top. Continuing to use Waypath after a change means accepting it. Where a change materially reduces your rights, we will give notice in the app first.
Law
These terms are governed by French law. If you are a consumer, you keep the protection of the mandatory rules of the country you live in, and you may bring proceedings in your own courts.
